Virginia Restaurant Minimum Wage 2026: Rates & Tip Credit

Running a restaurant in Virginia means staying current with wage requirements that directly impact your bottom line. As labor costs continue to rise, understanding how to properly compensate both tipped and non-tipped employees is essential for compliance management and profitability.

This guide breaks down what Virginia restaurant owners need to know about minimum wage laws for 2026, including base rates, tipped employee wages, overtime, and the proper application of tip credits. Operators Daily covers the workforce management and compliance topics restaurant operators face each year.

Key Takeaways

• Virginia's standard minimum wage increases to $12.77 per hour effective January 1, 2026, with scheduled increases to $13.75 in 2027 and $15.00 in 2028.
• Qualifying tipped employees may be paid a direct cash wage of $2.13 per hour, provided wages plus tips reach at least $12.77 per hour, a difference of $10.64. The maximum tip credit under the federal FLSA remains $5.12.
• Virginia maintains statewide wage uniformity with no local minimum wage ordinances, simplifying compliance for multi-unit restaurant operators.
• Nonexempt employees generally must receive overtime at 1.5 times their regular rate after 40 hours in a workweek, and tipped overtime cannot be calculated as 1.5 times the $2.13 cash wage.
• The statutory minimum wage rate rises approximately 17.5% from $12.77 in 2026 to $15.00 in 2028, requiring strategic planning for menu pricing and staffing models.

Understanding the Virginia Minimum Wage Landscape for 2026

Virginia's minimum wage structure operates under the Virginia Minimum Wage Act, which sets the floor for hourly compensation across industries in the state. For restaurant operators, this baseline applies to non-tipped positions like cooks, dishwashers, hosts, and bussers who do not regularly receive gratuities.

The state minimum wage in Virginia for 2026 is $12.77 per hour, representing a $0.36 increase from the 2025 rate of $12.41. This translates to approximately $748.80 in additional straight-time wage expense per full-time employee working 2,080 hours.

Unlike states such as California or Washington where cities and counties can set their own higher rates, Virginia maintains statewide uniformity. This means a restaurant in Richmond follows the same wage requirements as one in Virginia Beach or Northern Virginia. For multi-unit operators, this consistency simplifies payroll administration significantly.

Virginia's Scheduled Minimum Wage Increases

Virginia has already legislated future minimum wage increases, giving restaurant operators a clear planning window:

• 2026: $12.77 per hour (current)
• 2027: $13.75 per hour (7.7% increase)
• 2028: $15.00 per hour (9.1% increase from 2027)

For a restaurant with 10 full-time non-tipped employees moving from $12.77 to $15.00 across 2,080 hours each, the difference equals approximately $46,384 in additional annual payroll expense. This predictable increase schedule allows owners to adjust menu pricing, evaluate staffing ratios, and consider technology investments well in advance.

Comparing Virginia to Federal Minimum Wage Standards

The federal minimum wage has remained at $7.25 per hour since July 24, 2009. Virginia's $12.77 rate is 76% higher than the federal floor, and an employee covered by both laws is entitled to the higher applicable rate.

Virginia's position relative to neighboring jurisdictions creates competitive dynamics worth tracking:

• Washington, D.C.: $18.40 per hour effective July 1, 2026, with a $10.30 tipped direct wage
• Maryland: $15.00 statewide, with higher local rates in some counties, including up to $18.00 for certain Montgomery County employers as of July 1, 2026
• West Virginia: $8.75 per hour
• North Carolina: $7.25 per hour (federal minimum)
• Tennessee: $7.25 per hour (federal minimum)

This mid-range positioning gives Virginia restaurants a potential recruitment advantage over North Carolina and Tennessee while facing wage competition from D.C. and Maryland, particularly in the Northern Virginia region.

Virginia's Tipped Minimum Wage: What Restaurant Owners Need to Know in 2026

Tipped employees represent a distinct category under wage law. Servers, bartenders, and other front-of-house staff who regularly receive gratuities are subject to different direct wage requirements than their non-tipped counterparts.

The direct cash wage for qualifying tipped employees in Virginia remains $2.13 per hour for 2026. The critical requirement is that total hourly compensation, cash wage plus tips, must equal or exceed the standard minimum wage of $12.77 per hour.

Defining 'Tipped Employee' Under Virginia Law

Not every worker who occasionally receives a tip qualifies as a tipped employee for wage purposes. Under FLSA guidelines that Virginia follows, a tipped employee is someone in an occupation in which they customarily and regularly receive more than $30 per month in tips.

Positions that typically qualify include:

• Servers and waitstaff
• Bartenders
• Bussers (when tip pooling is in place)
• Delivery drivers
• Counter service staff receiving tips

Employees who receive tips only occasionally or in small amounts do not qualify for the reduced cash wage and must be paid the full $12.77 per hour.

The Relationship Between Tipped Wage and Overall Minimum Wage

The $2.13 cash wage is not the end of employer obligations. Employers must verify for each workweek that a tipped employee's total compensation reaches the $12.77 minimum, and any shortfall must be made up by the regular payday for the pay period in which that workweek ends.

Here is how this works in practice:

• A server works 40 hours in a week
• Cash wage: $2.13 × 40 = $85.20
• Minimum weekly earnings required: $12.77 × 40 = $510.80
• Tips must total at least $425.60
• If tips fall short, the employer pays the difference

Because a pay period may contain more than one workweek, averaging a strong week against a deficient one can produce a violation even when the pay period total looks sufficient. This "make-up pay" requirement is one of the most commonly violated aspects of tipped wage law. Employers who fail to cover the gap face back-pay liability and potential penalties from the Virginia Department of Labor and Industry.

Navigating the Tip Credit in Virginia for Restaurant Employees (2026)

The tip credit is the mechanism that allows employers to pay tipped workers a reduced direct wage. Understanding how to calculate and apply it correctly is essential for legal compliance.

Calculating the Allowable Tip Credit

Virginia permits qualifying tipped employees to be paid as little as $2.13 per hour in direct cash wages in 2026, provided wages plus tips equal at least Virginia's $12.77 minimum wage. That creates a $10.64 difference between the direct cash wage and the Virginia minimum.

Calculation formula:

Virginia Minimum Wage ($12.77) - Direct Cash Wage ($2.13) = $10.64 difference tips must cover

These are two distinct legal calculations, and the terminology matters. The $10.64 figure is the gap between the direct cash wage and Virginia's minimum wage. Separately, the maximum tip credit under the federal FLSA remains $5.12, the difference between the $7.25 federal minimum wage and the $2.13 direct cash wage.

The amount tips must cover is not additional money paid to employees. It is the portion of the minimum wage that tips are expected to satisfy, and employers can only rely on it when employees actually receive sufficient tips.

Conditions for Applying the Tip Credit

Employers cannot simply pay $2.13 and hope for the best. The FLSA requires specific conditions to be met:

1. Advance notice: Employees must be informed of the applicable tip credit provisions before the credit is taken; the notice may be oral or written
2. Tip retention: Employees must keep all tips, except for valid tip pooling arrangements
3. Compensation verification: Total tips plus cash wage must equal at least $12.77 per hour for each workweek
4. No tip confiscation: Employers cannot retain any portion of employee tips (aside from lawful tip pools)

Failure to meet any of these conditions can invalidate the tip credit, making the employer liable for the full minimum wage plus back pay.

Common Pitfalls in Tip Credit Application

Restaurant operators frequently make errors when applying the tip credit. The most common include:

• Failing to track tips by workweek: The $12.77 minimum applies to each workweek, not to pay-period or monthly averages
• Improper tip pooling: Managers and supervisors generally may not participate in mandatory employee tip pools, and when an employer takes a tip credit, the mandatory pool generally must be limited to employees who customarily and regularly receive tips
• Not covering shortfalls: When tips fall short, the employer must make up the difference by the regular payday for the pay period in which that workweek ends
• Missing documentation: Inadequate records of tips received and wages paid create audit risk

Different federal rules apply when an employer pays tipped workers the full applicable minimum wage directly and takes no tip credit; in that case a mandatory tip pool may include employees who do not customarily receive tips, such as cooks and dishwashers. Investing in proper workforce management software can help automate tip tracking and flag potential compliance issues before they become violations.

Overtime Requirements for Virginia Restaurants

Overtime is where tipped payroll most often goes wrong, and Virginia currently incorporates federal FLSA overtime requirements, exemptions, and calculation methods.

The 40-Hour Rule and Tipped Overtime

Unless an exemption applies, employees covered by the FLSA must receive at least 1.5 times their regular rate for hours worked over 40 in a workweek.

For tipped employees, the calculation requires particular care:

• Overtime is based on the full applicable minimum wage, not the reduced $2.13 direct cash wage
• Employers cannot calculate overtime by multiplying $2.13 by 1.5
• The permitted tip credit cannot be enlarged for overtime hours
• If the employee's regular rate exceeds the minimum wage because of other includable compensation, the overtime rate is higher accordingly

Salaried Managers and Overtime Exemptions

Restaurant managers are not automatically exempt from overtime because they are salaried or carry a management title. Most executive, administrative, and professional exemptions currently require at least $684 per week on a salary basis plus satisfaction of the applicable duties test. Misclassifying a working manager who spends most of their time on non-exempt duties is a common and expensive error.

Server Wages in Virginia: Beyond the Minimum (2026)

While the law sets minimums, actual server earnings in Virginia vary widely. Understanding the full compensation picture helps with recruitment and retention strategies.

Factors Influencing Server Earnings

Several variables affect what servers actually take home:

• Restaurant type: Fine dining establishments typically generate higher tips than casual or fast-casual concepts
• Location: Northern Virginia restaurants near D.C. often see higher average checks and tips than rural areas
• Shift timing: Dinner and weekend shifts generally produce better earnings than lunch shifts
• Customer volume: High-traffic locations create more tipping opportunities
• Service model: Full-service restaurants with longer guest interactions tend to yield higher gratuities

Bureau of Labor Statistics estimates for waiters and waitresses include tips and show substantial variation. Nationally, the May 2025 median was $16.94 per hour, while the top 10% earned more than $31.12 per hour.

Strategies for Fair Server Compensation

Restaurant operators looking to attract and retain quality staff should consider:

• Transparent tip distribution policies: Clear rules build trust and reduce disputes
• Consistent scheduling: Providing predictable hours helps staff plan their income
• Competitive base wages: Some operators pay above the $2.13 direct wage to attract talent
• Tip pooling transparency: If using tip pools, communicate allocation methods clearly

Compliance Checklist: Virginia Labor Laws for Restaurants in 2026

Staying compliant requires systematic attention to documentation, posting requirements, and payroll practices.

Posters and Notices

Employers with workers subject to the FLSA's minimum wage provisions must display the federal Employee Rights Under the Fair Labor Standards Act poster conspicuously in the workplace.

Virginia DOLI currently lists the 2026 Virginia Minimum Wage Notice as optional rather than required. Operators should check DOLI's required workplace posters page for the current list, since other state postings may apply depending on the workforce.

Posters should be placed in break rooms, near time clocks, or at employee entrances where employees can readily see them.

Payroll Best Practices for Tipped Employees

Proper payroll management for tipped staff requires:

• Per-workweek calculations: Verify minimum wage compliance for each workweek, not by pay-period average
• Tip reporting systems: Use POS or timekeeping software that captures declared tips
• Make-up pay processes: Automate detection of workweeks where tips fall short
• Overtime configuration: Ensure tipped overtime is not calculated from the $2.13 cash wage
• Record retention: Virginia requires covered employers to retain required paystub or online wage-accounting records for at least three years. Federal FLSA rules impose additional retention requirements, including three years for payroll records and generally two years for certain wage-computation records such as time cards and work schedules

Addressing Wage Violations

If employees believe they have been underpaid, they can file claims with the Virginia DOLI Payment of Wage Unit at (804) 786-2706. Claims may be submitted electronically, or by completing and mailing the required signed paper claim form.

Under Virginia Code §40.1-29, an employee action may recover unpaid wages, an equal amount as liquidated damages, prejudgment interest, and reasonable attorney fees and costs. A knowing failure to pay can lead to triple the wages due. A good-faith cure provision applies to certain actions commenced on or after July 1, 2026, where the employer satisfies its statutory requirements, including curing the underpayment within 14 days after notice.

Proactive compliance is always less expensive than reactive remediation.

Payroll and Workforce Management for Tipped Employees in Virginia

Managing payroll for a mix of tipped and non-tipped employees requires systems designed for the complexity of restaurant operations.

Integrating Payroll with Timekeeping

Manual tracking of hours, tips, and wage calculations creates error risk and administrative burden. Modern restaurant operators benefit from integrated systems that:

• Capture clock-in and clock-out times automatically
• Allow employees to report tips at shift end
• Calculate total compensation by workweek
• Flag shortfalls requiring make-up pay
• Generate compliance reports for audits

Leveraging Technology for Accuracy

Software solutions designed for hourly workforces can automate much of the compliance burden. Key features to look for include:

• Real-time tip tracking and allocation
• Automatic minimum wage compliance checks by workweek
• POS integration for tip capture
• Employee self-service portals for tip reporting
• Tax withholding calculations for tipped income

Comparing Virginia's Tipped Wage to Other States (2026)

Virginia's approach to tipped wages sits in the middle of the national spectrum, allowing a reduced direct wage while requiring total compensation to meet the state minimum.

States Eliminating the Tip Credit

Several states have moved to eliminate or significantly reduce the tip credit, requiring higher direct wages to tipped employees:

• California, Washington, Oregon: No tip credit; full minimum wage required before tips
• New York City: General minimum wage of $17.00 in 2026, with an $11.35 cash wage plus up to $5.65 tip credit for food-service workers and a $14.15 cash wage plus up to $2.85 tip credit for other tipped service employees
• Chicago: Previously planned to eliminate the tip credit by 2028, but the phase-out has been paused by the city council

These policies shift more labor cost directly to employers, often resulting in higher menu prices or service charges.

Impact on Restaurant Business Models

Virginia's $2.13 direct wage provides cost flexibility compared to no-tip-credit states. However, operators must weigh this against:

• Recruitment challenges: Workers may prefer nearby jurisdictions with higher guaranteed wages
• Compliance complexity: Tip credit requirements add administrative burden
• Income volatility: Server earnings fluctuate more than in full-wage states

Some Virginia restaurants are experimenting with no-tipping models or automatic service charges to provide income stability while managing labor costs predictably.

Future Outlook: Virginia Minimum Wage Beyond 2026

Planning for the near term is straightforward given Virginia's legislated wage increases through 2028.

Anticipated Wage Increases

The current law establishes:

• January 1, 2027: $13.75 per hour
• January 1, 2028: $15.00 per hour

Beginning January 1, 2029, Virginia's minimum wage is scheduled to adjust annually under the CPI-U formula established in state law. The Commissioner must establish each adjusted rate by October 1 of the preceding year, so operators should monitor announcements from the Virginia Department of Labor and Industry each fall.

Preparing for Future Wage Adjustments

With the statutory rate rising approximately 17.5% over three years, operators should take action now:

• Menu engineering: Analyze item profitability and adjust pricing strategically
• Labor optimization: Review scheduling efficiency and staffing ratios
• Technology investment: Automation and self-service can offset rising labor costs
• Service model evaluation: Consider counter service, QR ordering, or other labor-light approaches

The Bottom Line

Virginia is the rare state where the wage math looks simple and the exposure is not. One statewide rate, no local ordinances, and a $2.13 direct wage make payroll setup straightforward. But that $2.13 sits $10.64 below what a tipped employee must actually receive, and the entire difference rests on tips arriving and on the employer having satisfied the conditions for counting them. Lose that footing through a missed advance notice or an improperly composed tip pool, and the shortfall is owed for every hour at $12.77, with liquidated damages on top.

Two habits close most of that gap. The first is running the minimum-wage test per workweek rather than per pay period, since a strong week cannot subsidize a thin one and the make-up is due by the payday for the period in which the workweek ends. The second is treating overtime as its own calculation: never 1.5 times $2.13, and never assuming a salaried manager is exempt without testing the $684 weekly salary basis alongside the duties. With $13.75 arriving in 2027, $15.00 in 2028, and CPI-U adjustments from 2029 onward, the increases are visible far enough ahead to price for deliberately rather than react to. Frequently Asked Questions

What are the penalties for non-compliance with Virginia's minimum wage laws?

Under Virginia Code §40.1-29, an employee action may recover unpaid wages, an equal amount as liquidated damages, prejudgment interest, and reasonable attorney fees and costs, and a knowing failure to pay can lead to triple the wages due. A good-faith cure provision applies to certain actions commenced on or after July 1, 2026, if the employer meets its statutory requirements, including curing the underpayment within 14 days after notice. Remedies depend on the specific violation, so the most effective protection is maintaining accurate records and proactive compliance monitoring.

Does Virginia have different minimum wage laws for small businesses?

Virginia does not provide a general small-business exemption from its minimum wage, and DOLI's 2026 notice states that the Virginia Minimum Wage Act does not exempt workers based on employer size. However, the Act contains specific worker and employment-category exclusions in its definition of "employee," so coverage should be assessed under the statute rather than assumed from business size alone.

How often do Virginia's minimum wage laws typically change?

Virginia's minimum wage has been on a legislated increase schedule since 2021. The current law establishes rates through January 1, 2028, when the wage reaches $15.00 per hour. Beginning January 1, 2029, the rate is scheduled to adjust annually under the CPI-U formula in state law, with the Commissioner establishing each adjusted rate by October 1 of the preceding year. Restaurant operators should monitor General Assembly sessions and DOLI announcements for changes to this trajectory.

Are there specific record-keeping requirements for tipped employees in Virginia?

Yes. Virginia requires covered employers to retain required paystub or online wage-accounting records for at least three years. Federal FLSA rules add their own requirements, including three years for payroll records and generally two years for records used to compute wages, such as time cards and work schedules, along with additional recordkeeping obligations for employers taking a tip credit. Many operators use POS systems and time-tracking software to automate tip capture and ensure accurate documentation, since inadequate records can shift the practical burden of proof to the employer in wage disputes.

Can restaurant managers participate in tip pools in Virginia?

Generally, no. Under federal FLSA rules that Virginia follows, managers and supervisors may not receive employees' tips through a mandatory tip pool, even if they occasionally assist with service. When an employer takes a tip credit, the mandatory pool must also be limited to employees who customarily and regularly receive tips. Violations of tip pooling rules can invalidate an employer's ability to claim the tip credit, resulting in liability for the full minimum wage for affected employees and workweeks.
